Financial Regulatory Law
McDowell Purcell’s Professional Regulatory and Employment Law Units, comprising ten solicitors, have significant experience of advising in relation to financial regulatory law matters.
In particular, McDowell Purcell has provided legal advice to individuals in relation to investigations into financial institutions by the Director of Corporate Enforcement. McDowell Purcell has also advised entities in relation to financial regulation and queries from the Central Bank in relation to the regulatory status of certain entities. The Central Bank of Ireland published its Regulations and Standards of Fitness and Probity under Part 3 of the Central Bank Reform Act 2010 in September 2011.
The Central Bank Reform Act 2010 gave the Central Bank wide ranging powers across the financial services industry to:
- approve or veto the appointment of people to certain positions;
- investigate and where appropriate remove or prohibit certain position holders; and
- set statutory standards of fitness and probity across the financial services industry.
McDowell Purcell’s Professional Regulatory Unit has experience developed over a period of 30 years of advising CEO’s, Boards, Councils and registrants of various regulatory bodies.
In particular, McDowell Purcell has advised in relation to the following regulatory matters:
- Registration
- Fitness to Practise Inquiries
- High Court Appeals and Judicial Review proceedings
- Suspension applications to the High Court
As a result, McDowell Purcell is well placed to advise in relation to the Central Bank’s new Regulations and Standards of Fitness and Probity and in relation to registration matters with the Central Bank.
Textbook entitled “Disciplinary Procedures in the Statutory Professions”
Aideen Ryan, JP McDowell and Eimear Burke of McDowell Purcell’s Professional Regulatory Unit have drawn on their knowledge and experience of professional regulatory law to co-author the first Irish legal textbook on professional regulatory law. The textbook is entitled “Disciplinary Procedures in the Statutory Professions”. The textbook considers the legislation governing statutory professional regulation in Ireland and also considers the legal principles and case law in the area.
