Pensions Law Unit

McDowell Purcell’s pensions unit is headed up by James McConville. James has specialised in pensions law for over 10 years and advises on all aspects of the law relating to:

  • Occupational pension schemes
  • Small self-administered schemes
  • Personal pension plans (RACs)
  • Personal retirement savings accounts (PRSAs)
  • Approved retirement funds (ARFs) and approved minimum retirement funds (AMRFs)

His experience includes advising upon the impact upon retirement arrangements of the Pensions Act 1990 (as amended) and the requirements of the Revenue Commissioners under the Revenue Pensions Manual and the Taxes Consolidation Act 1997 (as amended). He also advises on pension adjustment orders under the Family Law Acts and recent legislative changes such as the new pensions levy under the Stamp Duty Consolidation Act 1999 (as amended by the Finance (No.2) Act 2011).

James advises upon the reorganisation of retirement arrangements – whether by way of M&As or MBOs or by way of the winding-up of defined benefit schemes and their replacement with defined contribution schemes or PRSAs. He has extensive experience of the drafting and amendment of the trust documentation of occupational pension schemes – including trust deeds, rules, deeds of amendment or substitution of trustees/employers and explanatory booklets. 

He advises clients on all compliance and regulatory aspects of pension arrangements, including their investment in regulated and unregulated markets. He also advises product providers in relation to the design of their pension products and their regulatory and compliance requirements.
