James heads McDowell Purcell’s Pensions Unit which specialises in retirement and benefits. James has specialised in pensions law for over 10 years. He advises employers, employees, trustees and their advisers on all aspects of the law relating to occupational pension schemes and other retirement benefits arrangements, including personal retirement savings accounts (PRSAs) and approved retirement funds.
James advises on the pensions aspects of M&A transactions and scheme reorganisations, including the review and drafting of trust documentation and explanatory booklets. He also conducts trustee training courses on pensions law.
James also specialises in the review of investment management agreements and other formalities relating to the investment of pension scheme funds, as well as on the pensions aspects of family law matters, including pension adjustment orders.
James is a member of the Association of Pensions Lawyers in Ireland and the International Pensions and Employee Benefits Lawyers Association.
James’s recent experience is detailed below.
- Advised a regulatory body on the impact of the Pension Levy and public sector pay cuts.
- Advised the trustees on the winding up of multiple Pension Schemes within a group of companies.
- Advised a trustee company with regard to the status of PRSA investments
- Advised a senior executive in relation to his cross-border pension benefits
- Assisted a group of members in a complaint to the Pensions Ombudsman concerning the winding up of their scheme.
