The Regulation of Lobbying Annual Report 2017

The Standard in Public Office Commission (“the Commission”), has published the third Lobbying Annual Report (“the Report”) since the commencement of the Regulation of Lobbying Act 2015 (“the Act”).

The report covers the Commission’s activities for the reporting year of 2017.

One of the main features of the Act in 2017, was the commencement of Part 4 which took effect from 01 January 2017. The provisions contained in Part 4 give the Commission the authority to investigate and prosecute relevant contraventions of the Act and to issue Fixed Payment Notices of penalties. The Report details that 522 fixed payment notices for late returns were levied in 2017.

Some of the key areas of the Report include:

  • operational details and determinations made by the Commission in 2017
  • publication of the Minister for Public Expenditure and Reform’s report on the first review of the operation of the Act
  • the commencement of the Act’s enforcement provisions
  • an overview of key issues encountered throughout the year and recommendations for legislative change.

Key areas lobbied about include health, economic development and industry, agriculture, justice and equality and housing.

The Report also outlines that, one of the planned activities in 2018 will include the launch of a consultative process with a view to developing a code of conduct for lobbying and it is expected that the Code will be completed by the end of 2018. Section 16 of the Act outlines that the Commission may produce, and from time to time revise, a code of conduct for persons carrying on lobbying activities with a view to promoting high professional standards and good practice.
